Purpose of the site
This site hosts the Breach Management Test, an informational tool from the Intelligence section of ILP Abogados. It allows a company to assess, on the basis of its own answers, to what extent it could demonstrate before a court that it acted with diligence if it suffered a security breach affecting personal data.
The result is expressed as a Defensibility Index out of one hundred, with an associated level. It measures the ability to prove, not technical quality: the tool does not review your systems or your documents and performs no security checks.
Access to the tool is free of charge and requires no registration. Contact details are requested only if you decide to receive the detailed report, and always voluntarily.

Terms of use
By using this site you undertake to:
- Use it in accordance with the law, in good faith and with this legal notice.
- Not use it for unlawful purposes or in any way that damages, overloads or prevents the normal operation of the service.
- Not attempt to access restricted areas, or to extract its content in bulk or by automated means.
- Provide truthful information if you decide to request the detailed report, and be answerable for the accuracy of what you communicate.
- Not enter third-party data in the forms without their knowledge, or identifying details of an actual incident or of the people affected by it.
ILP Abogados may suspend access, temporarily or permanently, for anyone who breaches these terms.
Intellectual and industrial property
The texts, the design, the graphics, the scoring model of the test, the downloadable documents and the source code of this site belong to ILP Abogados or to third parties who have authorised their use, and are protected by intellectual and industrial property law.
Consultation, printing and downloading of the materials is permitted for the internal, non-commercial use of your company, provided that they are not altered and that the attribution of authorship is preserved. Any other use — reproduction, distribution, public communication, transformation or commercial exploitation — requires prior written authorisation.
“ILP Abogados” and its distinctive signs are trade marks of the firm. Any third-party name appearing on the site — for example, that of the providers hosting the tool — is mentioned for identification purposes only and belongs to its owner; such mention implies no connection, sponsorship or recommendation.
Liability
The test result is calculated solely from the answers you provide, without reviewing your actual documentation. It is therefore an indicative assessment. ILP Abogados is not answerable for the decisions you take on the sole basis of that result.
The tool is not a security audit or a compliance report. A high Defensibility Index guarantees no outcome before a court, just as a low index prejudges no liability.
The firm endeavours to keep the information up to date and correct, but legislation and case law change. Always verify the references against the official texts before taking any decision.
The site is provided “as is”. Uninterrupted availability of the service and the absence of errors are not guaranteed, so far as the law permits.
Links to third-party sites are provided solely for your convenience. ILP Abogados does not control those sites and is not answerable for their content.

Amendments
ILP Abogados may amend this legal notice where the applicable rules or the service itself so require. Each legal text carries an identified version; when it changes, the consent given on the previous version is not carried over and you are asked again.
Governing law and jurisdiction
These terms are governed by Spanish law.
Where you act as a consumer, the courts and tribunals determined by consumer protection legislation shall have jurisdiction, and nothing in this notice limits that right. In all other cases — professional or business use of the site — the parties submit to the Courts and Tribunals of Madrid, waiving any other jurisdiction that might correspond to them.
To be confirmed by the firm: the submission to the courts of Madrid is a drafting proposal; it must be validated together with the exception provided for consumers.
